Please read these Terms of Service carefully before using the Grok Imagine service. By accessing or using our service, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using our service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms, you may not access the service.

2. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

3. Use of Service

Grok Imagine provides an AI-powered content generation service including images and videos. You may use our service only as permitted by law and these Terms. You agree not to misuse our service or help anyone else to do so.

4. User Content

Our service allows you to upload, submit, store, and share content. You retain all rights to your content, but you grant us a license to use, host, store, reproduce, modify, and distribute your content solely for the purpose of providing and improving the service. You are responsible for any content you upload and must have the necessary rights to share that content.

5. Request Interruptions and Billing

Request errors and interruptions fall into the following categories:

Client-Side Interruptions:

Whether the client actively interrupts the request due to no longer needing subsequent results, or interrupts the request due to timeout, when the server detects that the request has been interrupted, it will terminate the server-side model generation process. Between client interruption and server-side generation termination, several tokens may still be generated. Tokens that have been generated by the server and tokens input for model processing will be billed, and no further billing will occur after server-side generation is terminated.

Please note that in non-streaming output scenarios, it is necessary to wait for the model to complete output before returning the generated tokens. When a request is interrupted or times out, the server generates partial tokens but does not generate a complete response, so no generation information is returned to the client. The client will not receive model generation information for this request, but will incur costs for input tokens and generated but not output tokens.

Server-Side Interruptions:

During streaming output, if the server terminates the generation process after outputting partial content due to content review or other reasons, the tokens that have already been generated will still be billed.

Requests that encounter RPM/TPM and other limit errors will not start the model generation process, so no billing will be incurred.

6. Disclaimers

Our service is provided on an 'AS IS' and 'AS AVAILABLE' basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

In no event shall Grok Imagine, its directors, employees, or agents be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

8. General

These Terms constitute the entire agreement between you and Grok Imagine regarding our service and supersede any prior agreements. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
